Fund handling

Why CLX: exchange funds held by First National Bank of Durango in individual segregated Exchange Trust accounts. Disbursements require signatures of both CLX, as QI, and the taxpayer, described as complying with Treas. Reg. §1.1031 and Colorado C.R.S. §6-1-721. Bank administration fees apply.

Fee structure

Fees are disclosed in the exchange agreement (Why CLX). No public fee card on the pages cited.

Who keeps the float

Taxpayers are entitled to earned interest based on the First National Bank of Durango Investment Money Market rate from initial deposit of relinquished-property funds. Interest does not accrue on funds withdrawn during the first 30 calendar days after deposit in the Exchange Trust Account.

Who it is for

Nationwide real-property 1031 exchangers, with Southwest Colorado roots (Durango). QI since 1991. Office published: 970 Main Avenue, Durango, CO 81301; 877-776-1031.

Verdict

One of the clearer regional custody files: named CES®, FEA membership, individual segregated trust accounts at a named bank, dual QI-plus-taxpayer signatures tied to Colorado’s facilitator statute, and a published interest rule. Reverse and build-to-suit/improvement are on the homepage and types page. Fidelity and E&O dollar limits are not published on those pages — ask for certificates. Sharing a building with Colorado Title & Closing Services LLC is a logistics fact, not proof the title company is the QI or the parent.

Notes

This is a QI custody file, not a securities offering. CLX Exchange Accommodators, Inc. is the legal name on the homepage and contact page. The firm says it has served as a QI since 1991 and was the first exchange company in Southwest Colorado. Contact page: Robert Ptolemy, CES®, and Kathy Mousner (no CES® on that line); 970 Main Avenue, Durango, CO 81301.

Homepage and Why CLX state FEA membership and CES® on staff. Why CLX is the custody source: First National Bank of Durango; individual segregated Exchange Trust accounts; dual signatures (CLX and taxpayer) for disbursements; Colorado C.R.S. §6-1-721 cited by the firm. Interest: First National Bank of Durango Investment Money Market rate, with the 30-day no-accrual rule on funds withdrawn in the first 30 days. Fees are “full disclosure … in the Exchange Agreement,” not a public schedule.

Homepage, Why CLX, and Types of Exchanges cover reverse and build-to-suit/improvement (including parked-title and EAT structures). DST is not marketed there.

Why CLX says CLX is in the same building as Colorado Title & Closing Services LLC so closings can sit under one roof. That is not treated as common ownership unless a page says so.
