Fund handling
Homepage: all exchange funds are housed in segregated bank accounts bearing the exchanger’s tax identification number, FDIC insured to the extent provided by law; only highly rated banks are used as depositories. Brochure: independent accounts established for each client; funds held at an FDIC-insured bank; money market accounts. Products page: net sale proceeds are made payable to a newly established segregated exchange account. The deposit bank is not named.
Who it is for
Long Island–based QI for exchangers who want New York Deferred Exchange Corporation (NYDEC) — which says it was the first qualified intermediary to establish a practice in New York (1991) and describes itself as an independent boutique that has declined acquisition offers from banks and title companies — to handle forward, reverse, and construction exchanges in New York, New Jersey, and Connecticut and for clients elsewhere in the U.S. Headquarters: 6800 Jericho Turnpike, Suite 120W, Syosset, NY 11791. Branch: 71-15 Northern Boulevard, Jackson Heights, NY 11372. Phone 1-800-OK-NYDEC (1-800-656-9332). No principals or staff are named on the pages cited. CES®, bond and E&O amounts, the deposit bank, a fee card, and float are not on the pages cited.
Verdict
Long-running New York QI with a clear custody statement: segregated bank accounts titled under the exchanger’s tax ID, FDIC coverage to the legal limit, highly rated depository banks, and dual-signature accounts available on request. Reverse and construction exchanges use a single-member LLC with NYDEC as initial member. Its 2021 brochure claims FEA membership, but FEA’s current directory did not list it, so FEA is left unknown. Weak points: no bond or E&O amounts (only “bonded and insured”), no named bank, no named people, and a site that shows a 2019 copyright, a 2020 COVID page, and a brochure last modified in 2021, so confirm the details are current. Its blog recommends a specific outside DST firm by name; that is a referral, not a QI service, and a DST interest is a securities offering. “100% success rate” and “first QI in New York” are firm claims, not ratings. Ask for current bond and E&O certificates, the bank and account title, whether dual signature will be set up on your account, and who can release a wire before a large transfer.
Notes
This is a QI custody file, not a securities offering. The name on the site and brochure is New York Deferred Exchange Corporation (NYDEC). Confirm the named party on the exchange agreement. NYDEC is the intermediary that would hold exchange proceeds.
Homepage: all exchange funds are housed in segregated bank accounts bearing the exchanger’s tax identification number and are FDIC insured to the extent provided by law; only highly rated banks are used; accounts “can be structured to provide for ‘dual signature’ protection”; NYDEC is “bonded and insured without having a single claim made in its multi-decade history.” The brochure repeats this: independent accounts for each client, funds at an FDIC-insured bank, money market accounts, bonded and insured, and dual-signature accounts available. fundsHeld is therefore segregated and dualSignature is optional. No bank is named and no bond or E&O amount is published — do not invent one.
Products: forward exchanges (net sale proceeds paid to a newly established segregated exchange account); reverse exchanges using a single-member LLC with NYDEC as initial member during the parking phase; and construction exchanges using the same LLC structure, with construction payments authorized by the exchanger. Reverse and improvement are therefore yes.
FEA: the brochure (last modified May 2021) states “Member of Federation of Exchange Accomodators,” and the About page describes NYDEC’s early involvement with the FEA in the 1990s. But FEA’s own Find a QI Company directory, searched 2026-09-29 for “New York Deferred,” returned no results. The two sources conflict — the membership may have lapsed or be listed under another name — so company FEA stays unknown. Ask NYDEC whether it is a current FEA member.
Ownership: About says NYDEC principals have declined acquisition offers from large banks and title companies, “preferring to continue as an unencumbered independent practitioner.” No parent is named. No principals or staff are named anywhere on the pages opened, so CES® stays unknown.
DST: the blog says “Many of NYDEC’s clients elect to invest in Delaware Statutory Trusts (DST) as a Replacement Property alternative,” and names a specific outside DST firm as a resource it has used for over 15 years. A DST interest is a securities offering sold by a sponsor and registered representatives. NYDEC’s published role is qualified intermediary for exchanges into DSTs, not DST sponsor. Treat the named DST firm as a referral and ask whether any referral relationship exists.
Freshness: the site footer reads “Copyright 2019,” the COVID page discusses 2020 IRS notices, and the brochure PDF was last modified in May 2021. The COVID page also lists an office line (516-364-2949). Confirm that the program described is current.
“100% success rate,” “first qualified intermediary to establish a practice in New York (1991),” and “thousands” of exchanges are firm claims, not ratings. A fee card, float, and state registrations are not on the pages opened 2026-09-29.
Headquarters: 6800 Jericho Turnpike, Suite 120W, Syosset, NY 11791. Branch: 71-15 Northern Boulevard, Jackson Heights, NY 11372. 1-800-OK-NYDEC (1-800-656-9332).
Ask New York Deferred Exchange Corporation for current bond and E&O certificates, the bank and account title, whether your account will carry dual signature, and who can release a wire — then read those papers, not this summary.
