Arizona: a 2010 bill, not a current QI chapter we can cite

Arizona is not on theverified bonding tablebecause we could not open a current A.R.S. section that licenses or bonds 1031 exchange facilitators. An introduced 2010 bill would have done that. Current Title 6, Chapter 16, on the 2025 compilation we opened, is about financial-institutions data match — a different subject that reused the chapter number. Do not cite SB 1333 as if it were today’s statute.

SB 1333 (2010) — introduced text

Arizona Senate Bill 1333 (49th Legislature, 2nd Regular Session), introduced version atazleg.gov/legtext/49leg/2r/bills/sb1333p.htm, would have added Title 6, Chapter 16, “Exchange Facilitators,” with a purpose clause stating there were then no statutory requirements for monitoring 1031 facilitators, and with bonding / qualified-escrow alternatives in the bill text. “I Ver” / “p.htm” is the introduced print. This page does not treat that print as enacted law.

Current Title 6, Chapter 16 (as compiled)

The 2025 Arizona Revised Statutes Title 6 table of contents we opened (Justia compilation of A.R.S. Title 6) lists Chapter 16 as “Financial institutions data match and data exchange,” A.R.S. §6-1601 — surrender of assets of a delinquent taxpayer. That is not an exchange-facilitator statute. If a later session enacts a QI chapter, this page should be rewritten from that session law.

What to ask on an Arizona file

  • Federal QI status and account controls — there is no Arizona section number on this page to demand a statutory alternative.
  • Current certificates. Do not accept “Arizona requires $1 million” unless the speaker can open a current A.R.S. section, not SB 1333.

FAQ

Does Arizona license qualified intermediaries?

No current Arizona Revised Statutes chapter titled “exchange facilitators” was found. SB 1333 (49th Legislature, 2nd Regular Session, 2010) was introduced to add A.R.S. Title 6, Chapter 16 “Exchange Facilitators.” The 2025 Title 6 chapter list we opened uses Chapter 16 for financial-institutions data match — not that 2010 bill. Treat SB 1333 as a bill text, not as current bonding law.

Can I use the $1 million figure from SB 1333?

No. That figure is in an introduced bill. This page does not treat it as an Arizona statutory minimum. Ask the QI for today’s certificates.
