Florida: federal 1031 rules, no QI chapter we opened
Florida is not on theverified bonding tablebecause we did not open a Florida statute that licenses or bonds 1031 exchange facilitators. That is a sourcing result. It is not a claim that no Florida license (title, escrow, money-services, securities) could ever attach on other facts. The tax clocks remain federal.
Do not confuse Fla. Stat. §517.12 “intermediary”
Florida Statutes §517.12(19) (2024 text opened on the Florida Senate site) requires registration of an intermediary that facilitates the offer or sale of securities in accordance with §517.0611, with a $200 fee into the Regulatory Trust Fund. That is the Florida securities chapter. It is not Treas. Reg. §1.1031(k)-1(g)(4). A 1031 QI that does not offer securities is not licensed by that subsection on the text we opened. A DST subscription is a securities fact — seeDST as replacement property— and is still not a Florida QI license.
What still applies
IRC §1031 and Treas. Reg. §1.1031(k)-1. Identification, exchange period, constructive receipt, disqualified persons. Florida’s lack of a facilitator chapter on the sources opened is a custody-diligence fact: there is no Florida statutory bond alternative to ask for by section number. Ask the QI for certificates anyway. Seehow to choose a QI.
What to ask on a Florida file
- QI legal name; account title; who can wire.
- Current fidelity and E&O certificates — not a Florida statutory minimum we can cite.
- If someone says the QI is “licensed in Florida,” ask: licensed as what, under which chapter? §517.12 is the wrong answer for a 1031 cash holder.
FAQ
Does Florida license 1031 qualified intermediaries?
No standalone Florida exchange-facilitator or QI license chapter was opened for this page. Fla. Stat. §517.12(19) registers an “intermediary” that facilitates the offer or sale of securities under §517.0611 — a securities-crowdfunding intermediary, not a 1031 qualified intermediary. Do not treat a §517.12 registration as a QI charter.
Is there a Florida QI bond minimum?
Not on a facilitator chapter we opened. This page does not invent a Florida fidelity figure and does not copy another state’s minimum onto a Florida file.
